Would the CAB/CAA with NRC make the Indian muslims lose their Indian citizenship ? Arun clarifies all the doubts about the ongoing protests.
For the last few days we are witnessing a large number of protests allover India by the opposition parties, Communist students union SFI, DYFI, and Congress students union NSUI. Most of the protestors are based on the "WhatsApp Forwards University". There were also a large amount of protest from the Islamist groups and political parties against the recently passed CAB (Citizenship Amendment Bill) which is now CAA (Citizenship Amendment Act) after the President approval. There were some serious doubts raised that CAA with combine of NRC (National Register for Citizenship) would make the Muslims of India to evacuate and deport from India. But these are some rumors that are been spreaded by Anti-Social elements, opposition parties and Illiterate degree holders. Here I would clarify the doubts related to CAA and NRC.
The following are FAQs which I would brief it:
1) What is CAB/CAA 2019 ?
Citizenship Amendment Bill or Act 2019 is an act given approval by President of India after passing in Loksabha and Rajyasabha with BJP, BJD, YSR Congress, TRS, Shiv Sena, AIADMK, TDP, Akali Dal, JD(U), PMK, Asom Gana Parishad, Bodo People Front, SDF and many parties with complete majority. It deals with giving citizenship to the "Religiously Persecuted" minorities of Pakistan, Bangladesh, Afghanistan which are all the Islamic Countries. By which the minorities of Pakistan, Bangladesh, Afghanistan that is Hindus, Sikhs, Buddhists, Jain, Parsis, and Christains who are religiously persecuted or tortured by the majority people of those countries who are refugees in India till 2014 Dec 31st are to be given citizenship.
2) Do Indian Muslims be deported ?
No. TheCAA or CAB deals only with the Religiously Persecuted Minorities of Pakistan, Bangladesh, Afghanistan and it does not deal with Indian Citizens whether he/she is Hindu, Muslim, Sikh, Christain or buddhist.
3) Why Citizenship for Pak, Ban, Afghan Minority Refugees ?
When India partitioned India announced it as Secular state. Whereas Pakistan announced it as Islamic Republic Of Pakistan. At that time of Partition in 1947 Pakistan had about 21% of Hindus and 6% of other minority religions. After Pakistan lost war with India in 1971 East Pakistan got freedom and formed as Bangladesh and announced it as Islamic Republic. And the minority population in Bangladesh also religiously persecuted or tortured by the Majoritarians. Now they are reduced to 8%. Same situation is in Afghanistan with Taliban tortures. According to a report every year 5,000 Hindu Refugees are crossing over to India from Pakistan over religious tortures like Conversion, Girl Kidnapping etc.
4) Would the Combination of CAA & NRC would make Indian Muslims deport ?
No. There is a wide spread rumour that after CAA/CAB with implementation of NRC the Indian muslims without any documents to prove that they are Indian Citizens would be deported and Hindus without Documents would have CAA refugee provision to stay in India. But it is absolute false propaganda. They are spreading this rumour with greater confusion of linking Assam NRC and All over India NRC.
5) What is the difference between Assam NRC and Overall India NRC ?
After India won the war against Pakistan in 1971 East Pakistan was separated and got freedom from Pakistan. During the war and after math of the war Millions of Bangladeshi muslims crossed over to India in the parts of Assam and West Bengal. It was opposed by the people of Assam. Thus in 1985 Rajiv Gandhi the then Prime Minister called for the NRC for Assam based on the Assam Accord 1971. Earlier this year we saw the NRC completed in Assam. In that the people of assam was asked to provide documents that they lived in India and they were Indian citizens before 1971 (before Bangladesh Partition).
But the overall NRC will not be the same. Assam NRC was based on the Assam Accord 1971 and its process was based on how to evacuate the Bangladeshi immigrants. Here in allover India NRC we just need to provide the birth place, date, time and parents name. For this Birth certificate is enough to complete NRC process. So any Indian irrespective of religion with birth certificate will be safe in the NRC. If not available, you may have to provide such details of birth of parents, but no documents will be required to be compulsorily submitted w.r.t parents. The citizenship can be proved by submitting any documents relating to date and place of birth. The details of such admissible documents are yet to be decided. But they are likely to include voter card, passport, Aadhaar, license, insurance papers, birth certificate, school leaving certificate, land or house papers or such other documents issued by public authorities. The list of these documents is likely to be fairly long so that no Indian citizen is put to any undue harassment.

6) How is Citizenship decided ?
The citizenship will be decided as per The Citizenship Rules, 2009 as framed under The Citizenship Act, 1955. They are in public domain. There are five ways in which a person can become an Indian citizen:

No. NRC, as and when carried out, shall not affect any of the mentioned above.

Why does minorities of Myanmar and Srilanka like Rohingya Muslims and Srilankan
Tamils excluded ?
This
case is different from that one. As Srilankan Tamils and Rohingyas are
persecuted or tortured on the basis of Linguistic basis and not on religious
basis. In case if the Srilankan Tamils are included it may dilute their core
ideology of equal rights in Srilanka. This will affect the Srilankan tamils
residing in Srilanka which is their home. Once there were 1 lakh refugees in
tamilnadu but now there are only 60,000 refugees. The normalcy is slowly
returning in Srilanka and the Srilankan Tamils are returning back to their home
land.
The rohingyas are evacuated by
their own government due to their links with terrorist organizations like Al-Queda.
And they are entering India illegally through Bangladesh. There are serious
doubts araising as why the rohingyas are coming towards India and not near by
Islamic nations like Malaysia, Singapore and Bangladesh. Thus it affects the
claim of allowing rohingyas.
10) Why there are so many
protests in North East India?
The protest in North East India is different
from Muslims’ protest. North East people are protesting that the settlement of
any refugees may affect their culture and language of Indigenous community. But
the CAA clearly says the “Inner Line” limit of N-E States in regards to Assam
Accord 1971. Where as the Muslims protesting with mis information and lack of
communication and clarity about their citizenship.
The conclusion is simple that the ongoing protest shows the complete illiteracy of the protestors about the CAA and misformed linking of undrafted NRC bill. The anti social elements are intruding in the protests results in the violence. No government can over throw any citizenship of any religion. In case it tries won't the Supreme Court be silent ? So minorities need not fear. This bill is about the refugees of Pakistan, Afghanistan, Bangladesh and not about Indian Citizens.
